Judge Rules Against Utah GOP in SB54 Lawsuit

Brian Grimmett
U.S. Federal Courthouse District of Utah

A federal judge has ruled against the Utah Republican Party in its lawsuit over changes to Utah election law.

The Utah GOP claimed that the signature gathering thresholds for candidates seeking state legislative seats was unconstitutionally high. But Judge David Nuffer ruled that because all candidates have the opportunity to go through a party convention, which is undisputedly constitutional, it doesn’t matter if the alternative path meets constitutional requirements.

While this ends one part of the lawsuit, the Utah Supreme Court still has to decide if it is the party or the candidate that gets to decide which path to the ballot to take.
